Patents

Mauritius is a member of the Paris Convention and the WTO/TRIPS. Patent protection is available by way of a national filing.

Although Mauritius has not yet acceded to the PCT, the Act has specific provisions referring to the PCT and providing for international applications under PCT to designate Mauritius. However, until Mauritius accedes to the PCT it will not be possible to designate Mauritius in an international application under PCT.

Duration and Renewal

The term of a patent is twenty years from the filing date. Renewal fees are due annually commencing on the third anniversary of the filing date.

Designs

Mauritius is a member of the Paris Convention and the WTO/TRIPS. Design protection is available by way of a national filing.

Filing Requirements

  1. Power of Attorney (signed and legalized up to the consulate)
  2. Drawings, photographs or other adequate graphic representations of the industrial design
  3. An indication of the article which constitutes the industrial design or in relation to which the industrial design is to be used.
  4. Certified copy of priority document, if priority claimed, with verified English translation
  5. Assignment document

Duration and Renewal

Design registration is valid for an initial term of five years from the filing date, which is renewable upon payment of the required fees for two further terms of five years each.

The law provides for copyright in respect of artistic, literary and scientific works, including:

  • works of art, architecture, painting, drawing, sculpture, engravings, lithography

  • computer programs
  • works of folklore
  • derivative works.

Derivative works include

  • translations, adaptations, arrangements of works
  • collections and compilations of works.

Excluded from protection are:

  • ideas, procedures, systems, methods of operation, concepts, principles
  • official texts of laws, decisions by courts, or of administrative bodies.
